Sanibel Planning Commission Approves Waiver for Square | News, Sports, Jobs – SANIBEL-CAPTIVA


The Sanibel Planning Commission approved a plant buffer and landscaping exemption request for a shopping center at its recent meeting, and continued to consider a recommendation to city council to amend the code to allow additional seats for outdoor dining.

On July 13, the committee voted 6-0 to approve the exemption request submitted for Periwinkle Place at 2075 Periwinkle Way. The request was approved subject to the following conditions:

– Invasive alien vegetation listed by the city as well as invasive alien vegetation listed by the Florida Exotic Pest Plant Council (FLEPPC) as Class I invasive should be removed from all buffer zones (front, sides and back).

– Detailed plans, similar to those provided for the front buffer zone (Coastal Vista Design Plan of 6-23-21, as approved by the Planning Commission), must be provided for the rear and side buffer zones for review by municipal staff to ensure compliance with the waiver conditions granted and attached prior to implementation.

– Respect the installation and maintenance standards identified in chapter 122 – Vegetation at the time of installation for all buffers (front, side and rear).

– Rear and both side buffers must comply with Section 122-49 – Types, Varieties and Number for Small Tree / Medium Shrub and Small Shrub / Ground Cover categories. The buffer zone on the (east) side must comply with Section 122-48 – Location and Size of Required Vegetation Buffer Zones.

– The front buffer plan (Coastal Vista Design Plan dated 23/06/21) must be implemented within 120 days of the adopted resolution.

– Side and rear buffers, pending final staff review and approval of plant schedules, must be installed and completed no later than 15 months from the resolution passed for the west buffer, 27 months for the rear (south) buffer, and 39 months for the east buffer.

Ahead of the vote, Steve Hartsell of the Pavese law firm requested that additional documents be included with the terms on behalf of his client and owner, Dahlmann Periwinkle Place. The documents involved vegetation plans and plant counts for the buffer zones by the designer.

After discussions between the commission, city staff and Hartsell, including a short break to find common ground, the commission approved the inclusion of the attachments as reference material.

Also at the meeting, the commissioners reviewed a draft ordinance prepared by staff that seeks to amend the city’s ordinance code to solidify the outdoor dining pilot program that has been temporarily put in place for the pandemic. This would allow additional seating in restaurants and take out food stores.

During the discussion, a handful of proposed changes to the draft text were requested by the Commissioners. One was to clean up the text to “The maximum number of bonus outdoor seating allowed in a take-out food store is 15% of the total number of authorized seats associated with the store, or 16 seats, whichever is greater. The maximum number of bonus outdoor seats in a restaurant is 15% of the total authorized seats associated with the restaurant, or must not exceed 32 seats. “

A motion to continue the public hearing until the next meeting so that the changes could be made was carried 6-0.
