Watergate Detective Bob Woodward said a Conservative lawyer summoned by Capitol Hill riot investigators had worked to lose any claims of executive privilege.

John Eastman, who has written legal notes describing how former Vice President Mike Pence might attempt to overturn the 2020 election, made an admission months ago that could weaken any argument for keeping his conversations with the former President Donald Trump confidential, the reporter told CNN on Tuesday.

“Robert Costa and I did not find out, but our assistant who is a lawyer, Claire McMullen, is only bombarding us with research and information,” he said. Costa is a comrade Washington post journalist who co-wrote the new book Peril with Woodward.

“And she found out on May 5, John Eastman, in a podcast – now that’s before our book came out – specifically talked about the War Room and the Willard. [Hotel] and said he’s sort of coordinating all of the communication, ”Woodward continued.

“Then on a very important legal point he said, ‘I wouldn’t normally talk about things like this, but I was led by the President of the United States” – at the time it was Trump – ‘to say and talk’ – he therefore waived the privilege, ‘said Woodward. And traditionally the judges will look at that and say, ‘Hey, wait a minute, you’re talking about it, but you’re also telling your client, the President of the United States specifically said,’ Talk, explain. ‘ so how do you justify not speaking to this committee or a grand jury and then … you already have 1 1/2 feet in the door. “

In the May 5 interview, in which Eastman was speaking to Denver radio show host Peter Boyles, he spoke about his meeting with Trump and Pence over the contestation of the election results and said said he had permission to talk about it.

“And by the way, I wouldn’t normally be talking about a private conversation I have with a client, but I have the express permission of my client, the President of the United States at the time, to describe what happened – to honestly describe what happened in that conversation, ”he said.

The House committee investigating the Capitol Riot subpoenaed Eastman, along with several others, on Monday to search for documents and testimony.

“Eastman has reportedly informed President Trump and others that Vice President Pence may reject voters in certain states in order to deny Joe Biden a majority vote in the Electoral College,” the panel said in a statement. “In the days leading up to January 6, Mr. Eastman allegedly attended a briefing for nearly 300 state lawmakers regarding alleged electoral fraud, during which he told the group he was’ on duty legislatures to solve this problem, this blatant conduct, and make sure we don’t put some guy in the White House who wasn’t elected. Mr. Eastman is said to have attended the January 5, 2021 meeting at the Willard Hotel in Washington, DC, and spoke at the rally on the Ellipse on January 6 before the attack on the U.S. Capitol.

A letter to Eastman, signed by President Bennie Thompson, even quotes the May 5 interview, noting: “You have publicly stated that President Trump has authorized you to discuss the matters at issue, which waives any applicable privilege on lawyer-client and lawyer work products. . “

Eastman has yet to comment on the summons, but the lawyer recently distanced himself from the scenarios described in his memos during a National exam maintenance.

Trump, in court, and Steve Bannon argued that the information sought by the committee is protected by executive privilege, which Republican Jan. 6 panel Rep. Liz Cheney said “appears to reveal” that Trump was “personally involved in the planning and execution” of the events of January 6. The House voted for Bannon to despise Congress for defying the subpoena. If the Justice Department prosecutes Bannon and he is found guilty, he could face fines of up to $ 100,000 and up to one year in prison.
